The plaintiffs claimed that the defendant, the Doctor’s Associates Inc., who manages the franchises of Subway restaurants, engaged in fraudulent and deceptive advertising, sales, and marketing concerning the Subway footlong sandwiches because the footlong sandwiches were less than 12 inches when measured. These advertisements and marketing campaigns were available on the internet, television, magazines, and other print ads. The plaintiffs said that Subway violated their consumer rights since they did not get what they paid for.

This lawsuit is filed under Case No. 2: 13-md-02439-LA with Judge Lynn Adelman overseeing the procedures. The plaintiffs’, who are from different regions of the United States, consolidated their class action complaint and it is filed under “In Re: Subway Footlong Sandwich Marketing and Sales Practices Litigation.” Court proceedings are held at the United States District Court Eastern District of Wisconsin.
